1) Overview

Welcome to Hatton Hill Ltd (“Hatton Hill”, “we”, “us”, “our”). These Terms govern access to and use of our website, content and online store, and purchases from us (the “Services”), whether as a consumer or wholesale (B2B) customer. By accessing or purchasing via the Services, you agree to these Terms and our Privacy Policy.

2) Eligibility, Accounts & Security

You confirm you are the age of majority in your jurisdiction. If you create an account, you are responsible for your credentials and all activity under your account. We may suspend or terminate any account at our sole discretion.

3) Products, Descriptions & Availability

We use reasonable efforts to keep product information accurate; however, descriptions, specifications, packaging and pricing may change at any time without notice. Where any discrepancy exists, the product label shall prevail. All sales are subject to availability. If an item is unavailable, our obligation is limited to refunding the purchase price.

4) Orders & Acceptance

Your order is an offer to buy. An order is accepted only when we send a confirmation/dispatch notice and have processed payment. We may reject, limit or cancel orders (including suspected reseller orders) at our sole discretion. Your purchases are subject to our Return & Refund Policy.

5) Pricing, Taxes & Billing

Prices, discounts and promotions may change without notice. Unless stated otherwise, prices exclude applicable taxes, shipping and handling. You agree to provide current, complete and accurate billing and delivery information and authorise us (and our payment processors) to charge your chosen payment method.

6) Shipping & Risk of Loss

UK delivery terms are described in our Shipping Policy. Delivery times are estimates and not guaranteed. Title and risk of loss pass on dispatch from our facility. We are not liable for courier delays or events beyond our control.

7) Wholesale (B2B)

Wholesale transactions are governed by these Terms; however, consumer protection rights under the UK Consumer Contracts Regulations 2013 and the Consumer Rights Act 2015 do not apply to B2B sales. Wholesale orders are final and non-refundable except as required by law or at our sole discretion.

8) Returns, Hygiene & Food Safety

Due to hygiene and safety regulations for food, opened or unsealed products cannot be returned unless faulty or not as described. Consumer returns for unopened goods are handled under our Return & Refund Policy.

9) Intellectual Property

All content on the Services (text, images, logos, designs, etc.) is owned by Hatton Hill or its licensors. No rights are granted except a limited, revocable licence for personal, non-commercial use of the site. You may not copy, modify, distribute, or create derivative works without prior written consent.

10) Third-Party Services & Links

The Services may integrate third-party tools (e.g., payment, analytics) and link to third-party sites. Access and use are at your own risk. We are not responsible for third-party content, policies or performance.

11) Platform Relationship (Shopify)

Our store is hosted by Shopify, which enables us to provide the Services. Purchases are between you and Hatton Hill. Shopify is not responsible for sales, products or customer support relating to our Store.

12) Acceptable Use

You agree not to misuse the Services (including transmitting malware, scraping, circumventing security, infringing IP, or unlawful/abusive conduct). We may suspend or terminate access without notice for violations.

13) Feedback & Reviews

If you share feedback, reviews or suggestions, you grant Hatton Hill a perpetual, worldwide, royalty-free licence to use and display them in connection with the Services. You warrant you hold the necessary rights to provide such content.

14) Disclaimer of Warranties

Except as required by law, the Services and all products are provided “as is” and “as available”, without warranties of any kind (express or implied), including merchantability, fitness for a particular purpose, and non-infringement. We do not warrant uninterrupted or error-free operation.

15) Limitation of Liability

To the maximum extent permitted by UK law, Hatton Hill shall not be liable for any indirect, incidental, special or consequential loss (including loss of profits, revenue, data or business) arising out of or related to the Services or products. Our aggregate liability for any claim shall not exceed the amount you paid for the product giving rise to the claim, except where prohibited by law.

16) Indemnity

You agree to indemnify and hold harmless Hatton Hill, its directors, employees and service providers from claims, losses, and expenses (including reasonable legal fees) arising from your breach of these Terms or misuse of the Services.

17) Changes to the Services & to these Terms

We may modify or discontinue any feature, and update these Terms, at any time. Material changes will be notified as required by law. Continued use after changes take effect constitutes acceptance.

18) Assignment

You may not assign or transfer your rights or obligations under these Terms without our prior written consent. We may assign or transfer without notice.

19) Severability & Waiver

If any provision is found unenforceable, the remainder remains in effect. No waiver of any provision is a waiver of any other provision or a continuing waiver.

20) Governing Law & Jurisdiction

These Terms and any dispute or claim (contractual or non-contractual) are governed by the laws of England and Wales. The courts of England and Wales shall have exclusive jurisdiction.
